Do I need a Solicitor?

The answer is no, you don't need a solicitor. Most people in the UK believe that you need a solicitor in order to write your Will. This is a myth, there is no legal requirement stating that you need a solicitor to write your Will.

Technically, provided it contains all of the correct legal terms and is witnessed properly, you could write your own Will on a bit of scrap bit of paper, and it would be completely legally binding and valid.

Luckily you don't have to worry about that, you can simply buy a Will kit.

What do I do once complete?

After completing your Will kit, store it carefully. Avoid keeping it in a bank safety deposit box, as this can be a very long and difficult process for your executor to gain access to your Will after your passing.

Also avoid keeping your Will with a solicitor as they tend to charge you for keeping it.

We recommend you store your Will somewhere safe and dry, make sure to tell your chosen executor of its whereabouts.

What if I've already got a Will?

Using our Will Kit and making a new Will automatically revokes and invalidates all previous Wills. You can only have one valid Last Will and Testament at a time. So yes, you can create a new Will with us, and it will override any prior Wills.

How is it legal in Scotland?

Our Legal Will Kits are valid in Scotland as long as you follow Scottish Will law.

According to Scottish Will writing law:

  • Your spouse is entitled to at least one-third (33.3%) of your estate.
  • If you have children, they must also receive at least one-third (33.3%) of your estate, divided equally among them.

Additionally, Scottish law requires only one witness to sign your Will, though having two is also acceptable.
